1. Acceptance of Terms

Welcome to DFW ThreadWorks. By accessing or using our website, requesting services, or providing your contact information, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our website or services.

These Terms constitute a legally binding agreement between you ("Customer," "you," or "your") and DFW ThreadWorks ("Company," "we," "our," or "us").

2. Services

DFW ThreadWorks provides custom embroidery, screen printing, DTF printing, and related promotional product services to businesses and individuals in the Dallas-Fort Worth area and beyond.

2.1 Service Description

Our services include but are not limited to:

  • Custom embroidery on apparel and accessories
  • Screen printing and DTF printing services
  • Promotional products and branded merchandise
  • Design consultation and file preparation
  • Rush order services
  • Delivery and fulfillment services

2.2 Custom Orders

All orders are custom and made-to-order based on customer specifications. We reserve the right to refuse service or decline any order at our discretion.

3. Communication Consent

IMPORTANT: BY PROVIDING YOUR CONTACT INFORMATION (PHONE NUMBER, EMAIL, OR ANY OTHER CONTACT METHOD) THROUGH OUR WEBSITE, FORMS, PRODUCT FINDER, CALLBACK REQUESTS, OR ANY OTHER MEANS, YOU EXPRESSLY CONSENT TO THE FOLLOWING:

3.1 Telephone and SMS Communication Consent

You authorize DFW ThreadWorks, its employees, agents, representatives, and affiliated partners to contact you at the phone number(s) you provided for the following purposes:

  • Providing quotes and pricing information
  • Discussing custom apparel and printing projects
  • Order confirmations and updates
  • Customer service and support
  • Marketing and promotional communications
  • Follow-up on inquiries and abandoned carts
  • Surveys and feedback requests

3.2 Methods of Contact

You specifically consent to be contacted via:

  • Manual dialing by our staff members
  • Automatic telephone dialing systems (ATDS) or autodialer
  • Artificial or prerecorded voice messages
  • SMS/text messages sent manually or via automated systems
  • Email communications

3.3 Do Not Call Registry

Your consent applies even if your telephone number is registered on any federal, state, or company-specific Do Not Call registry. This consent overrides any such registration for communications from DFW ThreadWorks.

3.4 Message and Data Rates

You understand and agree that:

  • Standard message and data rates may apply to text messages
  • You are responsible for any charges from your wireless carrier
  • Message frequency may vary depending on your interactions with us

3.5 Not a Condition of Purchase

You understand that your consent to receive calls and text messages is not a condition of purchasing any goods or services from us. You may still place orders and use our services if you choose not to provide consent.

3.6 Revoking Consent

You may revoke your consent at any time by:

  • Replying STOP to any text message
  • Calling us at (716) 300-6607
  • Emailing us at hello@dfwthreadworks.com
  • Clicking "unsubscribe" in any email

Revoking consent may affect our ability to provide certain services or communications to you.

4. Ordering and Pricing

4.1 Quotes and Estimates

All quotes and pricing estimates are valid for 30 days from the date provided unless otherwise specified. Prices are subject to change based on material costs, design complexity, and quantity.

4.2 Order Acceptance

An order is not confirmed until we provide written confirmation and receive payment or deposit as required.

4.3 Payment Terms

  • New customers: Payment in full or 50% deposit required before production
  • Established customers: Net 30 payment terms may be available
  • Rush orders: Payment in full required upfront
  • Accepted payment methods: Credit card, ACH, check, wire transfer

4.4 Minimum Orders

Minimum order quantities may apply for certain services. We will notify you of any minimums during the quoting process.

5. Design and Artwork

5.1 Customer-Provided Artwork

Customers are responsible for providing print-ready artwork or paying for design services. We will provide a digital proof for approval before production.

5.2 Proof Approval

Customers must approve all proofs in writing before production begins. Once approved, we are not responsible for errors in spelling, design, or placement.

5.3 Copyright and Trademarks

Customers represent and warrant that they own all rights to artwork provided or have obtained necessary permissions. Customers indemnify us against any claims of copyright or trademark infringement.

5.4 Company Rights

We reserve the right to refuse to produce any artwork that we deem inappropriate, offensive, or potentially infringing on third-party rights.

6. Production and Delivery

6.1 Production Time

Standard production time is 7-10 business days after proof approval and payment receipt. Rush services are available for additional fees.

6.2 Delivery

Delivery times are estimates and not guaranteed. We are not liable for delays caused by shipping carriers, weather, or other circumstances beyond our control.

6.3 Holiday Guarantee

Our holiday delivery guarantee (e.g., December 23 delivery) applies only to orders placed before specified deadlines and is subject to terms communicated at the time of order.

7. Quality and Satisfaction

7.1 Quality Standards

We maintain high-quality standards for all our work. However, slight variations in color, size, and placement are normal in custom production and are not considered defects.

7.2 Inspection

Customers must inspect orders upon receipt and report any issues within 5 business days. We are not responsible for issues reported after this period.

7.3 Satisfaction Guarantee

Our 100% satisfaction guarantee covers defects in workmanship and materials. It does not cover customer errors in provided artwork, approved proofs, or normal wear and tear.

8. Returns and Refunds

8.1 Custom Products

Due to the custom nature of our products, we do not accept returns unless items are defective or we made an error in production.

8.2 Defective Items

If items are defective or incorrect, we will reprint or refund at our discretion. We must be notified within 5 business days of receipt.

8.3 Cancellations

Orders may be cancelled before production begins. Once production has started, orders cannot be cancelled, and deposits are non-refundable.

9. Limitation of Liability

To the fullest extent permitted by law:

  • Our total liability shall not exceed the amount paid for the specific order in question
  • We are not liable for indirect, incidental, consequential, or special damages
  • We are not liable for delays, lost profits, or business interruptions
  • We are not liable for third-party actions or failures (shipping carriers, suppliers, etc.)

10. Intellectual Property

All content on our website, including text, graphics, logos, and software, is our property or licensed to us and is protected by copyright and trademark laws. You may not use our content without prior written permission.

11. Privacy

Your use of our website and services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles.

12.2 Arbitration

Any disputes arising from these Terms or our services shall be resolved through binding arbitration in Dallas County, Texas, in accordance with the rules of the American Arbitration Association.

12.3 Class Action Waiver

You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes constitutes acceptance of the modified Terms.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
